This Acceptable Use Policy ("Policy") governs your use of the services provided by E-Warmup LLC ("Company," "we," "us," or "our"). By using our services, you agree to comply with this Policy. Failure to adhere to these terms may result in suspension or termination of your access to the services.

2.2. Compliance Requirements
- • Avoid deceptive practices: Ensure subject lines, 'From,' 'To,' and 'Reply-To' fields are accurate and not misleading. Subject lines must reflect the email's content.
- • Use valid domains: Do not conceal or use invalid/non-existent domain names or email addresses.
- • Identify advertisements: Clearly indicate that your email is a commercial advertisement.
- • Provide contact information: Include accurate business contact details, including a valid physical postal address or post office box.
- • Facilitate opt-outs: Provide a functional unsubscribe link or clear instructions for opting out of future emails. Respond promptly to opt-out requests without charging fees, requiring additional personal data, or imposing conditions.
- • Monitor compliance: Regularly review and ensure adherence to this Policy and applicable laws.
2.3. Representation and Warranty
- • You understand and will comply with this Policy.
- • You agree to meet the requirements of the CAN-SPAM Act and other applicable anti-spam laws, regardless of your business location.

3 . Intellectual Property and Content Compliance
3.1. Responsibility for User Content
You are solely responsible for all content you upload, post, or transmit through our services ('User Content'). E-Warmup LLC is not responsible for User Content, and you use the services at your own risk.
3.2. Content Requirements
- • You own the content or have the necessary rights and licenses to use and share it.
- • You do not use E-Warmup LLC’s or third-party domain names, brands, logos, trademarks, or taglines without prior written consent.
- • Your content does not violate any third-party rights, including publicity, copyrights, or contract rights.
- • Your content is not unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable.
3.3. Examples of Objectionable Content
- • Content promoting unlawful activity.
- • Defamatory, discriminatory, or mean-spirited content targeting protected groups (e.g., based on religion, race, sexual orientation, gender, or national origin).
- • Unauthorized advertising, chain letters, lotteries, or gambling-related content.
- • Content containing viruses, malware, or other harmful code designed to disrupt or damage systems or data.
- • Content impersonating any person or entity, including E-Warmup LLC or its representatives.
- • False or misleading information.
4 . Data Protection Compliance
4.1. Personal Data Responsibilities
- • Your content does not violate the privacy rights of third parties.
- • You collect and process personal data in compliance with applicable privacy laws, avoiding illegal or unethical methods (e.g., data theft, hacking, or phishing).
- • You have obtained consent or another legal basis for processing personal data, enabling E-Warmup LLC to use it to provide the services.
4.2. Compliance with Privacy Laws
- • U.S. federal data protection laws (e.g., Children’s Online Privacy Protection Act, Health Insurance Portability and Accountability Act, Gramm-Leach-Bliley Act, Federal Information Security Management Act).
- • Applicable state privacy laws.
- • International privacy laws (e.g., General Data Protection Regulation) if you operate in or process data from those jurisdictions.
5 . Additional Restrictions
- • Attempt to decompile, reverse engineer, or access restricted software, databases, or materials from the services.
- • Modify, adapt, translate, or create derivative works from the services or their content.
- • Interfere with the security or functionality of the services, including distributing viruses, overloading networks, or sending automated queries.
- • Bypass paywalls or other access restrictions.
- • Use the services in a way that harms E-Warmup LLC’s website, domains, or other customers’ domains.
- • Use the services for unapproved purposes or in violation of applicable laws or our Terms and Conditions.
6 . Enforcement and Modifications
6.1. Suspension or Termination
We reserve the right to suspend or terminate your account or access to the services, with or without notice, if you violate this Policy.
6.2. Content Moderation
- • Determine whether User Content complies with this Policy and remove or refuse non-compliant content.
- • Edit or reformat User Content.
- • Limit or revoke access to the services for posting objectionable content.
6.3. Policy Updates
We may modify this Policy at our discretion. Material changes will be communicated with at least 30 days’ notice. Continued use of the services after changes take effect constitutes acceptance of the revised Policy. If you do not agree with the updated Policy, you must discontinue using the services.
